Terms and Conditions
Last updated: 27th October 2026
Version: 1.1
1. Who we are
1.1 These terms apply to all services provided by The Foam Club Limited (company number 17452771) (“we”, “us”, “our”).
1.2 Our address for correspondence is 39 Fewston Drive, Harrogate, HG3 2FH. You can contact us by phone on +447709004345, by email at hello@thefoamclub.co.uk, or through our contact form.
1.3 Our registered office is at 39 Fewston Drive, Harrogate, HG3 2FH.
1.4 Our VAT number is 529 5733 60. All prices shown include VAT at the standard rate.
1.5 "You" means the person booking our services. These terms are written for consumers; private individuals booking for themselves. If you are booking on behalf of a business, section 16 applies to you instead.
2. What these terms cover
2.1 These terms form a legal contract between you and us. By booking a service either online, by phone, by message, or in person, you agree to them. They cover one-off bookings and memberships alike; section 8 sets out the extra terms that apply to memberships.
2.2 We may update these terms. The version in force is the one published on our website when you make your booking. We keep dated copies of previous versions and will send you one on request.
3. Our services
3.1 We provide mobile vehicle cleaning and valeting at an address you choose. The services we offer, what each one includes, and how long each takes are described on our website at https://thefoamclub.co.uk.
3.2 We will carry out our services with reasonable care and skill, using suitable products and equipment, as required by the Consumer Rights Act 2015.
3.3 What we cannot promise. Cleaning improves the condition of a vehicle; it does not restore it. We cannot guarantee the removal of:
- etched, bonded or ingrained contamination, including tree sap, tar, bird lime damage, iron fallout staining and water spotting
- scratches, swirl marks, stone chips, dents, oxidised or failing paint, or lacquer peel
- stains, odours, mould or damage in fabric, carpet, leather or headlining that has set, soaked through, or been present for a long time
- corrosion or pitting on wheels, trim or brightwork.
3.4 If we think a result is unlikely to be achieved, we will tell you before we start, and you can decide whether to go ahead.
3.5 Photographs. We usually take before-and-after photographs for quality and marketing purposes. We will not publish any photograph showing your number plate, your address, or anything that identifies you without your permission. See section 14.
4. Booking and quotes
4.1 A booking is confirmed only when we send you written confirmation by email or message. Until then, we have not accepted your booking.
4.2 Prices are listed on our website by service and vehicle size. Vehicle sizes are grouped as SMALL / MEDIUM / LARGE (SUV & 7-SEAT).
4.3 Additional charges. We may charge more than the listed price where the work needed goes materially beyond a normal clean of that vehicle size. This includes:
- excessive pet hair
- heavy soiling, mud, sand, or builder's dust
- bodily fluids, food spillage, or any biohazard
- smoke or heavy odour treatment
- roof boxes, tow bars, roof bars, or fitted accessories requiring extra work.
4.4 Pet hair. Pet hair is the one additional charge you settle before you book rather than on the day. Where the service includes work inside the vehicle, the booking form asks whether there is pet hair and, if there is, adds a fixed charge of £15 for some or £25 for a lot, together with extra time in the appointment. The charge and the total including it are shown to you before you confirm the booking. If we arrive and the pet hair is materially worse than you declared, clause 4.5 applies; if it is less, we charge the lower amount.
4.5 If we discover on arrival that additional charges apply, we will tell you the revised price before starting work. You can accept it, reduce the scope, or cancel. If you cancel at that point, no charge applies.
4.6 We reserve the right to decline any booking, and to decline to work on a vehicle if we consider it unsafe, unsanitary, or likely to be damaged by cleaning.
5. What we need from you on the day
5.1 Access and space. The vehicle must be parked somewhere legal, safe and accessible, with at least 1 metre of clear space around it, and space for our vehicle nearby. We cannot work on a public highway where this would obstruct traffic or put us at risk from passing vehicles.
5.2 Water and power. We bring our own power and all our own equipment, but not the water. If you haven't got a working outside tap, we can't wash the car, so please check before you book. In winter, make sure it isn't frozen or switched off at the isolator valve.
5.3 Keys and the interior. For any service including an interior clean, we need access to the interior. Please remove all child seats, personal belongings, valuables, money, electronics, documents and anything fragile or sentimental before we arrive. We are not responsible for loss of or damage to items left in the vehicle.
5.4 Telling us about problems. You must tell us before we start about any existing damage, faults or quirks. In particular loose or damaged trim, aftermarket paintwork or wraps, previously repaired panels, cracked or chipped glass, faulty or perished door and window seals, damaged alloys, non-standard parts, and any electrical fault. If you don't tell us, we are not liable for damage arising from it (see section 11).
5.5 Safety. We may need to stop or leave if there is aggressive behaviour, an unrestrained dog, a serious hazard, or if we reasonably feel unsafe. If we have to leave for these reasons, the visit is treated as a late cancellation by you.
5.6 If we arrive and cannot work because of something in this section, we will wait 15 minutes and try to contact you. If we still cannot start, clause 7.4 applies.
6. Weather
6.1 We work outdoors and in most British weather. We will not work in conditions that make a good result impossible or the work unsafe, including heavy or persistent rain, freezing temperatures, ice, snow, or high winds.
6.2 If we need to postpone for weather, we will contact you no later than 7:30am on the day of the appointment and offer the next available slot. No reschedule fee applies.
6.3 We cannot guarantee how long a finish will last. Rain, road spray, birds and trees are outside our control and are not grounds for a refund or a re-clean.
7. Payment, changes and cancellations
7.1 Payment. Payment is due on completion, unless we have agreed otherwise in writing. We accept Bank Transfer and Cash on the day. Memberships are paid by Direct Debit, or by bank transfer for bundles paid yearly; see section 8. If you decide not to go ahead with a membership after your first visit, that visit is paid for as a one-off booking; see clause 8.6.
7.2 Free changes. You can reschedule or cancel free of charge by giving us at least 24 hours' notice before the start of your appointment. Contact us by phone or WhatsApp on +447709004345.
7.3 Late cancellation. If you cancel or reschedule with less than 24 hours' notice, we charge 50% of the booking value. This reflects the fact that we reserve a fixed time slot for you, travel to you, and cannot realistically fill that slot at short notice. For membership visits, clause 8.14 applies instead.
7.4 No-shows. If we arrive at the agreed time and address and cannot carry out the service because you are not there, we cannot access the vehicle, or a requirement in section 5 is not met, the same 50% charge applies.
7.5 Cancellation after we've started. If you cancel once work has begun, the full charge of the booking value applies.
7.6 If we cancel. We may occasionally need to cancel or reschedule — illness, vehicle breakdown, equipment failure, or weather. We will tell you as soon as possible and offer the next available slot with no additional fee.
7.7 Late payment. If payment is not made when due, we may charge interest at 8% above the Bank of England base rate on the overdue amount, and may decline further bookings until the account is settled. We will always contact you first.
7.8 Late bookings. We don't take same-day bookings. If your appointment is less than 24 hours away when you request it, a late booking fee of 25% of the booking value applies. We will show you the exact amount before you confirm.
8. Memberships
8.1 This section applies if you join the Foam Club on a membership. Everything else in these terms applies to your membership visits too, except where this section says otherwise. If this section and our brochure ever disagree, these terms are the ones that count.
Joining
8.2 There are two kinds of membership:
- A bundle — a fixed mix of washes and valets spread across the year. There are five to choose from, priced at member rates with no extra discount and no premium.
- A repeat plan — one service, every month or every two months. Repeat plans are paid monthly only.
8.3 Your membership runs for twelve months from the date of your first visit. It can be frozen for up to three months during that period (clause 8.27), which pauses the twelve months rather than shortening them, so a membership frozen for the full three months runs for up to fifteen months in total.
8.4 Completing the form on our website is a request, not a membership. Nothing is charged at that point. We will contact you to agree your plan, price, calendar and the date of your first visit, and confirm these in writing. Our confirmation will also tell you the standard one-off price of your first visit.
8.5 Your first visit. Your membership starts after your first clean, so you can see the results before you commit. At the end of your first visit, we will send you a link to set up your payment. Once you have set it up, your membership starts from the date of your first visit, and that visit counts as the first session of your membership year. If you cancel your first visit with less than 24 hours' notice, or we can't carry it out for one of the reasons in section 5, clauses 7.3 and 7.4 apply, based on the standard one-off price of that visit.
8.6 If you decide not to continue. If you decide on the day not to go ahead, you pay the standard one-off price for your first visit on completion, in the same way as a one-off booking (see clause 7.1). If you haven't set up your Direct Debit, or paid for the year on a yearly bundle, within 7 days of your first visit, your membership will not start. We will send you a bill for your first visit at the standard one-off price, as shown in your confirmation, payable by bank transfer within 7 days. Nothing else is owed.
8.7 Once your membership starts, we will send you an email confirming your plan, your price and your calendar. Every visit goes in the diary, with a reminder the day before.
8.8 Prices are held for the twelve months of your membership, extended by any time it is frozen, up to fifteen months in total (clause 8.27). After that we will give you 30 days' notice of any change.
8.9 Multi-car memberships. A membership can cover more than one car at the same address under a single membership agreement. Each car has its own plan and calendar. The first car on the agreement is charged at our full member rates, and every additional car is charged at 25% off our member rates. The discount only applies to cars covered by the same membership agreement; separate memberships are charged at our full member rates. If cars leave the agreement and only one car remains, that car is charged at our full member rates from the following month's payment. Nothing extra is owed for earlier months.
Paying
8.10 Paying monthly. You pay by Direct Debit. The year's cost is split into twelve equal payments, which stay the same even in months when you have no visit. Your first payment is taken about a week after you set up your Direct Debit. If an amount is ever going to be different, we will tell you at least three working days before we collect it.
8.11 Paying yearly. Paying for the year is available on bundles only. You pay in one bank transfer, at a reduced rate compared with paying monthly, within 7 days of your first visit. If we don't receive it in that time, clause 8.6 applies. Repeat plans are paid monthly by Direct Debit.
8.12 Direct Debit payments are collected by The Foam Club Limited, company number 17452771, and are covered by the Direct Debit Guarantee. If we ever take the wrong amount, or take it on the wrong day, your bank will refund you immediately and in full. You can cancel a Direct Debit at any time through your bank. The full Guarantee comes with your confirmation email. Failed payments. If a Direct Debit payment fails, we will let you know and try to collect it again in line with our payment provider's Direct Debit rules. If a payment fails twice, we will pause your visits until your account is up to date.
Using your sessions
8.13 Sessions run for your twelve-month membership year. Use them or lose them. We will let you know if you fall behind. If you freeze your membership (clause 8.27), your membership year pauses and nothing changes while it is frozen. When it resumes, it carries on where it left off with the same number of sessions left, still on a use them or lose them basis.
8.14 Tell us at least 24 hours before a visit and we will move it rather than count it. If you cancel or move a visit with less than 24 hours' notice, that session counts as used.
8.15 If we arrive and cannot access the vehicle, or your outside tap isn't working, is switched off or is frozen, that session counts as used. Clause 5.6 applies in the same way as for a one-off booking. If your tap freezes unexpectedly in a way you couldn't reasonably have known about, we will rebook you free of charge instead.
8.16 If we cannot make it — weather, a vehicle problem, or anything else on our side — it never counts as a used session and it never costs you anything. We will move you to the next free slot.
Changing your plan
8.17 On a bundle, the mix of services is fixed at sign-up and cannot be swapped around during the year. The calendar is agreed when you join, so we both know which service falls in which month. Moving to a different bundle happens at the end of a membership year, not part-way through.
8.18 On a repeat plan you can move up to a larger service whenever you like. You can move down after three months.
8.19 If you change your car, tell us the size and we will adjust the price from your next payment.
8.20 Any change to what you pay is confirmed in writing before it takes effect.
Add-ons
8.21 You can ask for an add-on on the day. We will quote you the member price before we start. Add-ons only happen if there is time left in your slot; if there isn't, we will book you in rather than rush the job.
8.22 If you pay monthly, an add-on is added to your next Direct Debit collection. If you are on a bundle paid yearly, you pay for it on the day by bank transfer.
Ending your membership
8.23 Your right to change your mind. You have 14 days from the day your membership starts to cancel for any reason. If you do, we will work out the cost of any visits you have already had, charged at our standard one-off price, and compare it with what you have paid. If you have paid more, we will refund the difference within 14 days. If you have paid less, we will send you a bill for the difference, payable by bank transfer within 7 days. We will confirm the amount in writing either way. During these 14 days, this clause applies instead of the minimum term in clause 8.24 and the cancellation fee in clause 8.25.
8.24 Paying monthly. There is a minimum term of three months. After that, give us 30 days' notice to cancel. There is no cancellation fee. When you cancel, we will compare what you have paid with the member price of the visits you have had. If the visits come to more, we will collect the difference in your final payment and confirm the amount in writing first.
8.25 Paying yearly (bundles only). There is no minimum term. Give us 30 days' notice and a cancellation fee applies, equal to twice the member price of the highest-value appointment in your plan. For example, if the most expensive visit in your plan is an £85 full valet, the fee is £170. We will refund the monthly price of your bundle for each month left in your membership year after your notice ends, less that fee.
8.26 To give notice, email hello@thefoamclub.co.uk.
Freezing your membership
8.27 You can freeze your membership for up to three months in each membership year. Freezes are taken in whole months, and you can split them up across the year, for example one month in spring and two in summer. You can't freeze your membership during your three-month minimum term (clause 8.24).
8.28 To freeze your membership, email hello@thefoamclub.co.uk at least 7 days before you'd like the freeze to start.
8.29 While your membership is frozen, we don't make any visits and you pay £5 a month instead of your usual payment.
8.30 When the freeze ends, your membership picks up where it left off. The months you were frozen are added to the end of your membership year, so you don't lose any sessions, and your prices are held for that extra time.
8.31 If you paid for the year, please pay the £5 a month for your freeze by bank transfer before the freeze starts.
8.32 Nothing in this section affects your rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
9. If something goes wrong with the clean
9.1 Please check the vehicle before we leave. Telling us on the spot is by far the quickest way to put things right.
9.2 If you're not happy with the standard of a clean, tell us within 48 hours by calling +447709004345 and we will ask for you to send us photographs. If we agree the work fell short of reasonable care and skill, we will return and re-do the affected areas free of charge at the earliest available slot. If a repeat visit isn't practical or doesn't fix it, we will give you an appropriate price reduction or refund.
9.3 Nothing in these terms affects your statutory rights under the Consumer Rights Act 2015 — that our service is carried out with reasonable care and skill, within a reasonable time, and for a reasonable price where none was agreed. If we fall short, you are entitled to repeat performance or a price reduction.
10. Insurance
10.1 We hold public liability insurance with Chiswell to the value of £1,000,000.
11. Damage and liability
11.1 Report damage before we leave. Any claim for damage caused by us must be raised with us before we leave your address, or in any case within 24 hours, with photographs. This is because it becomes very difficult for either of us to establish what happened once the vehicle has been driven and parked elsewhere. This does not affect your rights where damage could not reasonably have been noticed in that time.
11.2 What we are not responsible for. We are not liable for:
- damage arising from a pre-existing fault or condition you did not tell us about under clause 5.4 — including perished or faulty door, window and boot seals allowing water in, loose or previously damaged trim, badges or mouldings, and previous poor-quality repairs
- damage to aftermarket parts, wraps, vinyls, non-factory paint or accessories not fitted to manufacturer standard
- lacquer, paint or trim that fails during normal careful cleaning because it was already failing
- corrosion, pitting or discolouration revealed (rather than caused) by cleaning
- loss of or damage to personal items left in the vehicle
- water ingress into a vehicle left with a window, sunroof, boot, door or convertible roof open or faulty.
11.3 What we are responsible for. We are responsible for loss or damage you suffer that is a foreseeable result of us breaking this contract or failing to use reasonable care and skill. Our total liability for any one booking is limited to £1,000,000, in line with our insurance cover.
11.4 We do not limit or exclude our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
12. Complaints
12.1 If you're unhappy, contact us first at +447709004345. We will acknowledge within 2 working days and aim to resolve within 14 days.
12.2 If we can't resolve it between us, you can contact the Citizens Advice consumer service for free advice on your options.
13. Vouchers, offers and referrals
13.1 Introductory and discounted offers are limited to one per household unless stated otherwise, and cannot be combined with other offers.
14. Your personal information
14.1 We collect and use your name, contact details, address, vehicle details and payment information in order to provide our services. We handle it in line with UK data protection law and our privacy notice.
14.2 We keep your details for six years after your last service, in line with company record-keeping requirements.
14.3 We will only send you marketing messages if you have agreed to receive them, and you can opt out at any time.
14.4 We take before-and-after photographs of vehicles we clean. We may use them on our website and social media, but we will blur or crop number plates and will not include anything identifying you or your address, unless you have given us permission.
14.5 You have rights over your data, including the right to ask for a copy, to correct it, or to ask us to delete it. Use our contact form and choose "My data".
15. General
15.1 Force majeure. We are not liable for failing to perform if we're prevented by something outside our reasonable control. We will contact you and either rearrange or refund.
15.2 Transferring the contract. You can't transfer your rights under this contract to someone else without our agreement. We may transfer the contract if our business is sold, and will tell you in writing if we do.
15.3 Severability. If any part of these terms is found to be unenforceable, the rest continues to apply.
15.4 Delay. If we don't insist on something straight away, or delay in taking action, that doesn't stop us doing so later.
15.5 Governing law. These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales.
16. Business customers
16.1 If you book as a business (including fleet, dealership, taxi and lease-hire work), you are not a consumer. Section 9 and clause 11.3 do not apply, and the following changes apply:
- payment terms are 30 days from invoice date.
- we exclude all implied terms to the fullest extent the law allows
- we are not liable for loss of profit, loss of business, loss of use of a vehicle, or any indirect loss.
